## Terms and Conditions for Use, Reproduction, and Distribution

This license is based on the Creative Commons Attribution 4.0 International License (CC BY 4.0) with the following additional terms:

### 1. Grant of License

Permission is hereby granted, free of charge, to any person obtaining a copy of this software and associated documentation files (the "Software"), to use, copy, modify, merge, publish, distribute, sublicense, and/or sell copies of derivative works or larger software projects that include the Software, subject to the following conditions:

### 2. AI Training Restriction

The Software shall not be used for the purpose of training machine learning models or artificial intelligence systems. If an AI is found to have been trained on this software or products derived from this software, the entire AI model is forfeit to required open-source and free distribution immediately after legal confirmation that the AI was indeed trained using the software. 

This investigation must be conducted by a mutually non-associated third party and will be paid for by the software author if they require it. In cases of suspected or alleged AI training using the Software, the copyright holder reserves the right to request an independent third-party audit of the AI model's training data to verify compliance with this restriction. The third-party auditor will be selected through mutual agreement.

### 3. Acknowledgment Requirement

Acknowledgment of the use of the Software is required in any product that incorporates it. This acknowledgment can be in any relevant manner visible in a non-intrusive but non-hidden place, for example:

- Including the full SmnSource License, signed with the author's details (only if the author requires).
- Providing direct credit in the product's credits section or in existing license files with the following statement:

Link: [optionally added by author].
```
### 4. Change Requirement

The Software must be modified in a substantial way before it can be sold, unless integrated or used as part of a broader product. Selling the Software as distributed alone, as is, is not permitted.

- A substantial modification is defined as a change that alters the core functionality, purpose, or user interface of the Software. This includes but is not limited to:
    - Adding new features or functionalities.
    - Modifying existing functionalities to serve a different purpose.
    - Creating a new user interface or significantly altering the existing one.
    - Integrating the Software into a larger system where it becomes an integral component of a new product or service.
- Merely renaming, repackaging, or redistributing the Software without substantial changes does not constitute a valid modification.
### 5. Disclaimer of Warranty

The Software is provided "as is", without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and noninfringement. In no event shall the authors or copyright holders be liable for any claim, damages, or other liability, whether in an action of contract, tort, or otherwise, arising from, out of, or in connection with the Software or the use or other dealings in the Software.

### 6. Additional Restriction Notice

Users of this software are expected to act in good faith and not engage in behavior that would undermine the intent of this license. When sublicensing, or changing terms in your own product using this software, you may not override conditions that include, but are not limited to, respecting the AI training restriction, providing the necessary acknowledgments, and not restricting others from using this software under the terms of this license.
